West Virginia’s AG officially calls on VP Harris to remove Biden from office by invoking 25th amendment

West Virginia Attorney General Patrick Morrisey has called on US Vice President Kamala Harris to invoke her powers under section 4 of 25th Amendment against President Biden, saying he is “physically unable to perform the duties of his duties”

In a letter to Harris dated Tuesday, Morrisey argued Biden’s mental health is a serious concern after a 388-page special counsel report was released last week. He said Americans have watched as Biden has experienced a “profound” cognitive decline. He asked her to look past her personal relationship with the president and evaluate the situation objectively.

Special Counsel Robert Hur’s special counsel report raised serious concerns about the 81-year-old president’s mental and physical condition.

“President Biden’s cognitive decline is of great concern to Americans, especially during these times that our nation is facing crisis after crisis both here and abroad,” Morrisey wrote. “We need a president who is mentally fit.”

Morrisey’s letter comes four days after Special Counsel Robert Hur, tasked with looking into his handling of classified documents, announced Biden had committed a crime but should not be charged.

Hur noted that “Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,” according to the attorney general’s Office.

Morrisey is one of seven Republicans running for governor in the state’s May 14 primary.

VP Kamala Harris called the report politically motivated.

The 25th Amendment was passed by Congress in 1965 in order to clarify presidential succession following the assassination of former President Kennedy. It also included a section allowing the vice president and the Cabinet to remove a president from office if they are deemed physically incapable.

Other elected officials have also called for the 25th Amendment to be invoked after the release of the Hur report, including Sen. Josh Hawley (Missouri), Rep. Claudia Tenney (New York 24th Congressional district), and Rep. Guy Reschenthaler (Pennsylvania 14th Congressional district).
